Dyle mobile TV December Giveaway – Official Rules
No purchase or payment of any kind is necessary to enter or claim prize. A purchase does not increase your chances of winning.
1. Eligibility: The Dyle mobile TV December Giveaway (the “Giveaway”) is open exclusively to legal U.S. residents who are at least eighteen (18) years of age at the time of entry. Employees of Dyle, and their respective affiliates, partners, subsidiaries, franchises, distributors, advertising and promotion agencies, and the immediate families or household members of each are not eligible to participate. The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, Sponsor’s Privacy Policy and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Sponsor of this Giveaway is Mobile Content Venture, 10201 W. Pico Avenue, Los Angeles, CA 90064 (“Sponsor“). The Administrator of this Giveaway is Horn Group, 55 Broad Street, New York, NY 10004.
2. Timing: The Giveaway begins at 12:01 a.m. ET on Thursday, December 12, 2013 and lasts until 12:00 p.m. on Monday, December 16, 2013 (the “Giveaway Period”). Administrator’s computer is the official time keeping device for this Giveaway.
3. How to Enter: During the Giveaway period in order to be eligible, you must 1) Use Vine to create a video why you want to the an Audiovox mobiletv receiver; 2) Follow Dyle mobile TV (@DyleMobileTV) on Twitter; 3) Tweet your Vine and include the hashtag #DyleVineGiveaway and the DyleMobileTV (@DyleMobileTV) handle in your tweet. All steps described above must be met for eligibility. Entries generated by a script, macro or other automated means will be disqualified. Entrants must accurately provide all of the requested information to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Entrants becomes the property of Sponsor. ELIGIBLE ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL RULES. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. Participation in the Giveaway constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules. Sponsor reserves the right to disqualify any Entrant that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor’s decision not to enforce a specific provision of these Official Rules does not constitute a waiver of that provision or of the Official Rules generally. Sponsor has the right to change the Giveaway Period, and all other dates or deadlines set in connection with this Giveaway, at any time and in its sole discretion and notice will be posted on the Giveaway Homepage.
4. Selection of Winners: Five (5) winners will be selected at random on or about Monday, December 16, 2013 at 4 p.m. ET (from among all eligible entries submitted during the Giveaway Period) conducted by representatives of Dyle, whose decisions are final and binding in all matters relating to this Giveaway. The grand prize winners will be notified via Twitter on or about Monday, December 16, 2013, and will be given instructions on how to claim prize. Time will be of the essence in awarding this prize. Upon notification, the winners will have 24 hours to provide contact information through a direct message to @DyleMobileTV. Winners may be announced on Dyle’s Twitter and Facebook feed. Odds of winning depend on the number of eligible entries received.
5. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY MAIN SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE GIVEAWAY SHOULD SO INDICATE, UNLESS AND UNTIL WINNER’S ELIGIBILITY HAS BEEN VERIFIED AND HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. MAIN SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE ENTRY AND IS VOID AND WILL NOT BE HONORED.
6. Verification of Potential Winners: Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winners may be required to verify address and complete, sign, and return within twenty-four (24) hours an affidavit of eligibility, a liability release, and, unless prohibited by law, a publicity release and other legal documents as may be required by Sponsor in its sole discretion (collectively, the “Prize Claim Documents”) covering eligibility, liability, advertising, publicity and media appearance issues. Failure to return the Prize Claim Documents within the specified time period may result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries for that prize. Upon notification, the will have 24 hours to provide contact information. Winners may be announced on Dyle’s Twitter feed. Odds of winning depend on the number of eligible entries received.
7. Prize: Five (5) winners will receive one (1) Audiovox mobiletv receiver. Prize is non-transferable and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of equal or greater value. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Approximate Retail Value (ARV) of the prize: $129.99. Other restrictions may apply. Limit one prize per household. The prize and all portions of the prize, are awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation.
8. Acceptance Official Rules: As a condition of entry, participants fully and unconditionally agree to these Official Rules and to the Sponsor’s decisions, which are final and binding in all respects.
9. Releases/Indemnity: By participating in this Giveaway and/or by accepting any prize that he or she may win, each Entrant agrees to release Sponsor and Administrator, and all entities involved in the production, sponsorship and/or promotion of the prize or Sponsor’s programming, or any part thereof, and each of their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers and all entities involved in the production, sponsorship and/or promotion of the prize, or any part thereof, including, without limitation, the producers of Sponsor’s programs; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals’ respective successors, representatives and assigns (collectively, the “Released Parties“) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Giveaway and/or acceptance or use of the prize. The Released Parties are not responsible for lost, late, incomplete, damaged, stolen, invalid, unintelligible or misdirected purchase information. The Released Parties are not responsible if online service or equipment is interrupted including without limitation (1) interruptions to any network, server, Internet, Web site, telephone, satellite, computer or other connections, (2) failures of any telephone, satellite, hardware, software or other equipment, (3) garbled, misdirected or jumbled transmissions, or traffic congestion, or (4) other errors of any kind, whether human, technical, mechanical or electronic, or (5) the incorrect or inaccurate capture of information or the failure to capture any such information, or (6) printing or typographical errors. Winner shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (a) Winner’s participation in the Giveaway; (b) a breach or allegation which if true would constitute a breach, of any of winner’s representations, warranties or obligations herein; and (c) acceptance, possession, grant, or use of any prize, including without limitation, personal injury, death and property damage arising therefrom.
10. Disputes: In the event of a dispute as to any winner who entered by making an online entry, potential winners may be required to show proof of identification.
11. Publicity and Liability: As a condition of entry, you grant consent to Sponsor and its agents to use of your name, likeness, voice, biographical information and entry materials for in programming or publicity or advertising in any media or manner, without further payment, consideration, notice or approval and without geographic or time limitation. You agree that Sponsor and its subsidiaries and affiliated companies and all their advertising and promotion agencies will have no liability whatsoever in connection with this Giveaway and, you shall hold them harmless for any injuries, losses or damages of any kind that you or others may incur as a consequence of your participation in the Giveaway or your acceptance, use or misuse of a prize. Sponsor and its affiliates are not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.
12. Conditions of Participation: Sponsor reserves the right in its sole discretion to modify, cancel, terminate, and/or suspend the Giveaway and to disqualify any individual who tampers with the entry process, violates these official rules, or acts in a disruptive or unsportsmanlike manner. In the event that the Giveaway is terminated early, Sponsor reserves the right, but not the obligation, to award prizes to persons who entered prior to the date of termination. Without limiting the foregoing, Sponsor may lock out any entrant who, in its sole judgment, has been disqualified, has questionable eligibility or is otherwise ineligible to enter. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE GIVEAWAY. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
13. Disputes/Choice of Law: This Giveaway is governed by the laws of the United States and the State of California, without respect to any choice of law or conflict of law principles that would result in the application of any law other than that of California. As a condition of participating in this Giveaway, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Giveaway, shall be resolved individually through binding arbitration, without resort to any form of class action, in accordance with the arbitration provision set forth below.
14. ARBITRATION PROVISION: By participating in this Giveaway, each entrant agrees that any and all disputes the entrant may have with, or claims entrant may have against, the Released Parties relating to, arising out of or connected in any way with (i) the Giveaway, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum. The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed upon by the participant and Sponsor. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Giveaway. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award special or punitive damages against the participant or Released Parties. For more information on the Forum and/or the Forum’s Code of Procedure, please visit their website at www.arb-forum.com. If any part of this Arbitration Provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this Arbitration Provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein.
15. Entrants’ Personal Information: Information collected from entrants is subject to the Sponsor’s Privacy Policy (https://dyle.tv/privacy/).
16. Winner: The winning entrants will be contacted and asked to provide a working address for which the prize will be sent. Dyle will assume all shipping costs. U.S. shipping only.

19. Winner: To obtain a copy of the Winner list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to “Dyle mobile TV Giveaway Winner’s List/Rules C/O Horn Group, 55 Broad Street, Floor 29, NY, NY 10004.” Requests for the names of the winners must be received no later than December. 19, 2013. Vermont residents may omit return postage.
